Agreement to Terms

These Terms of Service constitute a binding contract between you and ATTROCK Consultancy Private Limited , an Indian company with its registered office at 33/34 Mansarwar, Jaipur, Rajasthan, India — 302020 . References to "ATTROCK," "we," "us," or "our" mean ATTROCK Consultancy Private Limited. References to "you" or "your" mean the individual or entity accessing or using the Colytics AI platform.

By accessing the Platform, signing up for early access, creating an account, or continuing to use the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not accept these Terms, do not use the Service. Your electronic acceptance — through account registration or continued use — is valid and enforceable as a contract under the Indian Contract Act, 1872 and the Information Technology Act, 2000.

Eligibility

You must be at least 18 years of age to use the Service. By registering, you represent that you have the legal capacity to enter into binding contracts under the laws of India. If you are using the Service on behalf of an organisation, you represent that you are duly authorised to bind that entity to these Terms. You must not be barred from receiving services of this nature under any applicable law, including sanctions or export control regulations. We may suspend or terminate accounts where eligibility representations are found to be inaccurate.

Account Registration

To use the Service, you will need to register an account. You agree to provide accurate information — specifically, your name and email address — and to keep this information current. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account, whether or not authorised by you. Notify us immediately at help@colytics.ai if you suspect any unauthorised access.

We may suspend or terminate your account if we reasonably believe you have provided false information, breached these Terms, or engaged in fraudulent or unlawful activity.

Description of Services

Colytics AI is a software-as-a-service platform that uses artificial intelligence to generate visibility insights, recommendations, and reports. The Service is delivered via cloud-based infrastructure. We may modify, suspend, or discontinue features at any time as the product evolves, and we will not be liable for any such change. The Service's availability may depend on factors outside our control, including internet connectivity and the performance of third-party services we rely upon.

Early Access and Beta

Colytics AI is currently in early access / beta . This means the Platform is still under active development. Features may be incomplete, unstable, or change without notice. We do not guarantee any specific uptime, availability, or performance during this phase. Your data may be modified or reset as part of our development and testing — please do not rely on the Platform as a permanent data repository while we are in beta.

If you provide feedback, suggestions, or bug reports, you agree that we may use them for any purpose without compensation or attribution.

AI-Generated Content

You will be interacting with artificial intelligence systems. The Platform generates recommendations, reports, and insights using third-party AI models, including those provided by OpenAI, Anthropic/Claude, Google/Gemini, and xAI/Grok . We do not control or operate these underlying models, and we make no representations about their outputs.

AI outputs may contain errors, omissions, inaccuracies, biases, or fabricated content. You must independently verify all AI-generated outputs before relying on them or taking any action based on them. AI outputs do not constitute legal, financial, medical, or professional advice of any kind. ATTROCK is not liable for any decisions, actions, or losses that result from your reliance on AI-generated content — you assume that risk entirely.

Where the European Union Artificial Intelligence Act applies, we disclose that you are interacting with an AI system and that content generated through the Platform is artificially produced. We encourage appropriate caution and human oversight.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use AI outputs generated through your account for your internal business purposes. This is a licence, not a transfer of ownership. We and our licensors retain all rights in the underlying AI models, algorithms, and training data.

Acceptable Use

You agree to use the Service for lawful purposes only. Specifically, you must not:

  • reverse engineer, decompile, or attempt to derive the source code of the Platform or its AI models;
  • scrape, crawl, or use automated means to extract data from the Service without our prior written consent;
  • submit prompts designed to manipulate AI systems into generating harmful, illegal, or prohibited outputs ("jailbreaking" or "prompt injection");
  • use the Service to generate or distribute unlawful, defamatory, discriminatory, or infringing content;
  • use the Service to develop or train competing AI models without our express written permission;
  • interfere with the integrity or performance of the Service or circumvent any access controls or usage limits;
  • use the Service in any manner that violates applicable law.

We reserve the right to investigate violations, remove offending content, suspend or terminate accounts, and report unlawful activity to the appropriate authorities.

Intellectual Property

All rights in the Platform — including software, code, algorithms, user interfaces, trademarks, logos, and documentation — are and shall remain the exclusive property of ATTROCK and our licensors. These Terms do not grant you any intellectual property rights except as expressly stated.

You retain ownership of the data you submit to the Service. By using the Platform, you grant us a non-exclusive, royalty-free licence to process your data solely for the purpose of providing, maintaining, and improving the Service. That licence terminates when you delete your account, except where we are required to retain data by law or for legitimate business purposes such as backups and audit logs.

Payment

Future payments will be processed through Stripe, Inc. By providing payment details, you authorise us and Stripe to charge your designated payment method for all applicable fees. Pricing, subscription tiers, and billing cycles will be published on the Platform before any charges apply. All fees are exclusive of applicable taxes, which you are responsible for paying. We may modify pricing with reasonable notice, and changes will take effect at the start of your next billing cycle.

If a payment fails, we may suspend your account until payment is successfully processed. You remain liable for all unpaid amounts.

Data and Privacy

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. The data we collect is limited — primarily your name and email address . Please review the Privacy Policy to understand our practices.

Marketing Communications

By creating an account or signing up for early access, you consent to receive marketing communications from us by email. You may unsubscribe at any time by clicking the unsubscribe link in any marketing email or by contacting us at help@colytics.ai . Even if you opt out of marketing messages, you will continue to receive transactional emails — account notifications, security alerts, billing communications, and the like.

Third-Party Services

The Service integrates with and depends on third-party services and AI models, including but not limited to those named in the AI-Generated Content section above, as well as Stripe for payment processing. Your use of those third-party services is governed by their own terms and privacy policies. We are not responsible for their availability, accuracy, content, or practices, and we assume no liability for any loss or damage arising from your use of them.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We expressly disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free service.

During the early access period, the Service may contain bugs, defects, or inconsistencies. We make no warranty that the Service will meet your requirements or achieve any particular results. This disclaimer extends to all AI-generated outputs, which may be inaccurate, incomplete, biased, or unreliable. Nothing in these Terms excludes any statutory consumer protection rights you may have under the Consumer Protection Act, 2019 or other applicable law.

Limitation of Liability

To the maximum extent permitted by law, ATTROCK shall not be liable for any indirect, incidental, consequential, punitive, or exemplary damages — including lost profits, revenue, data, or goodwill — arising from your use of or inability to use the Service, even if we were advised of the possibility of such damages. Our total aggregate liability for all claims arising from these Terms or the Service shall not exceed INR 10,000 (for free users) or the total amount you paid to ATTROCK in the 12 months preceding the event giving rise to liability (for paid users), whichever is higher.

This limitation does not apply to death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, gross negligence or willful misconduct, or liability that cannot be limited under applicable consumer protection law.

Indemnification

You agree to indemnify and hold harmless ATTROCK and our officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your breach of these Terms, your violation of any law or third-party right, or your misuse of AI outputs. We reserve the right to assume control of any matter subject to your indemnification at our own expense, in which event you agree to cooperate with our defence.

Termination

You may terminate your account at any time by contacting us at help@colytics.ai or through your account settings. We may suspend or terminate your account, with or without notice, for breach of these Terms, non-payment, prolonged inactivity, requests by law enforcement, discontinuation of the Service, or technical or security issues.

Upon termination, all licences granted to you cease immediately. We will delete your data within a reasonable period, except where retention is necessary for legal compliance, defending legal claims, fraud prevention, or backup archives — which we retain for a commercially reasonable period before deletion.

Governing Law and Dispute Resolution

These Terms are governed by the laws of India . The parties agree to first attempt to resolve any dispute through good-faith negotiation for at least 30 days. If negotiation fails, the dispute shall be finally resolved by binding arbitration administered in accordance with the Arbitration and Conciliation Act, 1996 , conducted in Jaipur, Rajasthan in English, before a sole arbitrator. The arbitral award shall be final and binding. This arbitration agreement is a core term of these Terms — your consent to arbitration is a condition of using the Service.

Either party may seek urgent interim or injunctive relief from the courts of Jaipur, Rajasthan to prevent irreparable harm — this does not waive the agreement to arbitrate. Subject to the foregoing, the courts of Jaipur, Rajasthan shall have exclusive jurisdiction over any dispute that is not subject to arbitration.

Your rights under any applicable consumer protection law — including the Consumer Protection Act, 2019 — are not affected by this section.

General

If any provision of these Terms is found to be invalid or unenforceable, it shall be modified or severed to the minimum extent necessary, and the remaining provisions shall continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and ATTROCK concerning the Service. No waiver of any provision is effective unless in writing. You may not assign these Terms without our prior written consent; we may assign them freely.

We may modify these Terms from time to time. Material changes will take effect no sooner than 15 days after we post the updated Terms on the Platform and notify you by email. Continued use of the Service after changes take effect constitutes acceptance. If you do not agree to revised Terms, stop using the Service and terminate your account.
